西南大学法学院2012年度《法哲学:深度阅读》研究生课程通告

人:法学博士

课程主旨:小学大学两个方面训练法科以及其他人文社会科学研究生的研究能力。小学方面的训练涉及经典文本的阅读与翻译,大学方面的训练涉及经典文本所蕴涵内在义理的分析与阐发。

课程内容:精读以下三部经典文本:

           1. De essentia legis(《论法之本质》)(Summa Theologiae, Ⅰ-Ⅱ, q.90)(拉丁文-英文/德文/中文)

           2. The Concept of Law (《法律的概念》)(英文-中文)

           3.《汉书·刑法志》

           说明:第一个文本属于《神学大全·论法》的第一个部分,主要讨论法是什么?问题。《神学大全·论法》乃中世纪最伟大的哲学家、神学家与法学家托马斯·阿奎那所作之传世经典,为自然法学派的奠基之作,是我们理解融合了希腊理性精神与基督教精神的西方法律思想的一把钥匙。第二个文本乃新分析法学派的奠基之作。第三本书是理解中国法律思想的一把钥匙。

基本要求:第一本书为课堂精读文本。我会将本书的拉丁文本、德译本和五个比较有影响力的英译本发给听课者,由听课者课下选择一个英译本或德译本,先行翻译有关内容,上课时我将带着大家逐句讨论各个英译本与德译本在理解拉丁文原文上的成败,并引导大家讨论拉丁文文本自身所蕴涵的内在义理。另外两本书由同学们课下自己选择一本精读,每月提交一份读书报告。学期结束前交给我一篇书评。

De Lege

 

Consequenter considerandum est de principiis exterioribus actuum. Principium autem exterius ad malum inclinans est diabolus, de cujus tentatione in Primo dictum est. Principium autem exterius movens ad bonum est Deus, qui et nos instruit per legem et juvat per gratiam. Unde primo de lege, secundo de gratia dicendum est.

Circa legem autem, Primo, oportet considerare de ipsa lege in communi; ecundo,de partibus ejus.  

Circa legem autem in communi tria occurrant consideranda, primo quidem, de essentia ipsius; secundo, de differentia legum; tertio, de effectibus legis.

Der äüßere Seinsgrund, der zum Bösen geneigt macht, ist der Teufel; über die von ihm ausgehende Versuchung wurde im ersten Buch gesprochen (Fr. 114: Bd. 8). Der äußere Seinsgrund aber, der zum Guten hinbewegt, ist Gott: Er unterweist uns durch das Gesetz und er hilft uns durch die Gnade.  Was aber das Gesetz betrifft, so ist nachzudenken: erstens über das Gesetz selbst im allgemeinen, zweitens über seine Unterarten [Fr. 93 ff.]. Zum Gesetz im allgemein ist dreierlei zu untersuchen: erstens das Wesen des Gesetzes, zweitens der Unterschied der Gesetze [Fr. 91], drittens die Wirkungen des Gesetzes [Fr. 92]. ”

But the extrinsic principle moving to good is God, Who both instructs us by means of His Law, and assists us by His Grace: wherefore in the first place we must speaks of law; in the second place, of grace.

Concerning law we, must consider—(1) Law itself in general; (2) its parts. Concerning law in general three points offer themselves for our consideration: (1) Its essence; (2) The different kinds of law; (3) The effects of law.”
